Terms of Service

These Terms of Service (“Terms”) govern your use of the PoolsRoute platform (the “Service”) operated by PoolsRoute (“we”, “our”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old and authorized to bind your business to these Terms. The Service is intended for businesses providing pool service or related field-service operations. It is not a consumer product.

When you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. Notify us at security@poolsroute.dev if you suspect unauthorized access.

You retain all rights to the data you enter into the Service (customer lists, service records, photos, notes — “Your Data”). You grant us a limited license to process Your Data solely for the purpose of providing the Service to you.

You are responsible for the accuracy and lawfulness of Your Data, including obtaining any consent required from your end customers to upload their information into the Service.

You agree not to:

• Use the Service to violate any law, intellectual property right, or third party's privacy.
• Attempt to circumvent security, reverse engineer, decompile, or extract source code.
• Send spam, abusive messages, or unsolicited communications via the Service.
• Use the Service to scrape competitive intelligence or harvest data en masse.
• Resell or sublicense access to the Service without our written agreement.
• Upload viruses, malware, or content that is illegal, threatening, or abusive.

The Service is offered on a paid subscription basis (with limited free tiers from time to time). Pricing is published on our website at the time you subscribe. Subscriptions renew automatically until canceled.

You may cancel at any time from your account settings or by emailing billing@poolsroute.dev. Cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.

We aim for 99.5% uptime but do not guarantee uninterrupted availability. We perform scheduled maintenance and may suspend the Service to address security incidents or comply with legal demands. We are not liable for outages caused by third-party providers (Cloudflare, Apple, Google, internet service providers).

You may terminate your subscription at any time. We may terminate or suspend your account immediately if you violate these Terms, fail to pay fees, or engage in conduct that may harm other users or the Service.

On termination, you may export Your Data via our CSV export endpoints for up to 30 days, after which we permanently delete it (except for legally required retention).

The Service, including all software, designs, logos, and documentation, is the property of PoolsRoute and is protected by copyright and trademark laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for your business operations.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

TO THE FULLEST EXTENT PERMITTED BY LAW, POOLSROUTE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, EVEN IF ADVISED OF THEIR POSSIBILITY.

You agree to indemnify and hold PoolsRoute harmless from any claim, loss, or expense arising from (a) Your Data, (b) your use of the Service in violation of these Terms, or (c) your violation of any law or third party right.

We may update these Terms from time to time. Material changes will be announced via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of law principles. Any disputes will be resolved in the state or federal courts located in Maricopa County, Arizona.
